Product Warranty

WARRANTY

a) GreensGroomer WorldWide, Inc. warrants all GreensGroomer branded products against defects in materials and workmanship under normal use for a period of ONE (1) YEAR from the date of purchase by the original end-user/purchaser.

If a defect arises and a valid claim is received within the warranty period, GreensGroomer will replace defective parts with new, user-installable parts that GreensGroomer provides in fulfillment of its warranty obligation. GreensGroomer will pay the expense of shipping the replacement items as well as the expense for return shipping of the defective parts.  Labor shall be performed without charge to GreensGroomer.  Defective parts must be returned using the prepaid shipping method provided by GreensGroomer.  If defective parts are not returned within 30 days, an invoice will be generated for the replacement parts and customer will be responsible for the charges.

Replacement of product or part does not extend the warranty period beyond the original warranty expiration date. 

EXCLUSIONS AND LIMITATIONS

GreensGroomer is not responsible for damage arising from failure to follow instructions relating to the product’s use.  GreensGroomer does not warrant that the operation of the product will be uninterrupted or error-free.

This warranty does not apply: (a) to consumable parts (listed by equipment below) unless damage has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches and/or dents; (c) to damage caused by accident, abuse, misuse, alteration, neglect, improper or inadequate maintenance, flood, fire, earthquake or other external causes; or (d) if serial number has been removed.

Consumable parts exclusions:

GreensGroomer (model: 720E, 720HDE, 720SDE, 720SDM, 724, 724HD, 724SD)

Brushes are not warranted due to expected, normal wear.

Spring Tine Rake (model: STR, STR2)

Spring Tines are not warranted due to expected, normal wear.

GreensSlicer (model: TS-48)

Tine Shafts are not warranted due to expected, normal wear.

LitterKat (model: 760)

Brushes are not warranted due to expected, normal wear.

Accessories (model: SFR, SFS)

Sports Field Rake and Sports Field Scarifier are not warranted due to expected, normal wear.

b) GreensGroomer’s sole liability, and the customer’s sole remedy, for any breach of warranty shall be performance of the warranty obligations pursuant to subsection (a) above. 

c) GreensGroomer’s warranties as set forth above shall not be enlarged, and no obligation or liability shall arise or grow out of, GreensGroomer’s rendering of technical advice or service in connection with the customer’s purchase.

LIMITATION OF LIABILITY

In no event shall GreensGroomer’s liability under, arising out of, or relating to this agreement exceed the amount paid to GreensGroomer or to a GreensGroomer authorized dealer by customer for the equipment or goods giving rise to such liability.  In no event will GreensGroomer be liable for lost profits, loss of use, cost of procurement of substitute goods or services, or any other special, incidental, indirect, or consequential damages, however caused, and on any theory of liability, whether for breach of contract, tort (including negligence and strict liability), or otherwise.  These limitations shall apply whether or not GreensGroomer has been advised of the possibility of such damages and notwithstanding any failure of essential purpose of any limited remedy.  The parties acknowledge that the purchase price was determined based upon the foregoing limitation of liability.

THE WARRANTIES SET FORTH ABOVE, ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPSE.
